What you will learn:
New York City Summons Court has undergone significant changes in recent years, but tens of thousands of New Yorkers face criminal prosecution in the court every year. Non-citizen New Yorkers can be affected by those dispositions, and the need for immigration advice applies equally to these cases. Recently, the NYPD has begun to target New Yorkers for criminal summons in increased numbers. That can expose non-citizen New Yorkers to immigration enforcement.
This CLE will briefly cover criminal defense counsel’s Padilla obligations when dealing with criminal summonses. It will discuss best practices for intake, special considerations in the current mass deportation environment, and specific immigration consequences to consider. The course will also address frequently asked questions about dispositions.
